Please read these conditions carefully before using the Chocolate Empire website. By using this website, you signify your agreement to be bound by these conditions.

These terms and conditions do not affect Your statutory rights.

Whilst We endeavour to ensure that all information on this site is correct, the contents of this site are provided to you "as is" without representation or warranty of any kind (express or implied) including, without limitation, any implied warranties of merchantability, fitness for a particular purpose or non-infringement. We accept no liability for any statement, inaccuracy or omission on this site. We accept no liability for any direct, special, indirect or consequential loss or damages of any kind resulting from the use of any information obtained directly or indirectly from this site or for any viruses that may infect your computer equipment or other property on account of your access to, use of and browsing in this site. All such liability is excluded to the fullest extent permitted by law. The information on this site is subject to change and may be amended or withdrawn at any time without notice. These Conditions of Use may be changed at any time without notice.

We take all reasonable steps to protect Your personal information. All the data collected by Us is stored on a secure server. The secure server software encrypts all information You input before it is sent to Us.

Privacy and Data Collection

When You make a purchase We need to collect certain information to process Your transaction and fulfill Your order. We do not sell, rent or disseminate this information to any third party for marketing or any other purposes. We do not hold your credit card details online once the order has been completed.

Account Details

If You use the website, You are responsible for maintaining the confidentiality of Your account and password and for restricting access to Your computer to prevent unauthorised access to Your account. You agree to accept responsibility for all activities that occur under Your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform Us immediately if You have any reason to believe that Your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner.

All content included on the website, such as text, graphics, logos, button icons, and images belong to Us, and are protected by United Kingdom and international copyright laws. You may only read, view and print website material for personal, non-commercial use only.

You may not copy, distribute, sell, publish, display, transmit, reproduce or decompile any part of the material by any means (electronic or not) or for any purpose include it in any derivative works.

Trademarks

Our graphics, logos, page headers, button icons, scripts and service names are the trademarks or trade dress of The Chocolate Empire Limited and may not be used in connection with any product or service without Our written authorisation.

Section 3: Conformation of Your Order

Order Security

If You pay by credit or debit card, Your details are handled by Us on a secure server using encryption. While it is impossible for any web site to be completely impregnable to fraud, Our secure server and encryption offers a high level of security.

Conformation of Order

When You place an order to purchase a product We will send You an e-mail confirming receipt of Your order and containing the details of Your order including transaction and order reference numbers. Your order represents an offer to Us to purchase a product which is accepted by Us when We process payment for your order.

When We accept Your order, We will send a Dispatch Confirmation E-mail. Any products on the same order which We have not confirmed in a Dispatch Confirmation E-mail to have been dispatched do not form part of that contract. If You have incorrectly entered Your email address Your confirmation and dispatch email may fail. Therefore, as long as payment has been processed successfully this will in no way affect Your order.

Failure by Us to send a receipt confirmation email or dispatch confirmation email in no way invalidates Your offer or Our acceptance of your offer.

Prices & Product Details

All Our prices quoted are in British pounds and include VAT. We endeavour to ensure that the information shown on the web site is as accurate as possible however we cannot guarantee the accuracy of the information and offer no warranties as to the accuracy.

All products and services are subject to availability and may be withdrawn from sale at any time. If for any reason goods ordered are not available You may be offered an alternative. This alternative will be offered by telephone or email. We will never ship an alternative product without obtaining Your full authorisation.

Returns Policy

If you wish to return your order you must contact us within 24 hours and a formal agreement must be made and the product must then be returned within 48 hours of the agreement. After this period, no return will be accepted. Any return accepted by Us because of a visible fault or the non-conformity of the products delivered ascertained by Us will enable the You to receive a free replacement or the restitution of a credit note in Your favour, with the exclusion of any other form of indemnity or the payment of damages and interest.

Cancelling Your Order:

The right of withdrawal of 8 days does not apply to contracts for the supply of perishable food products such as chocolates. Your Modification or cancellation of the order may be accepted whist the parcel is in preparation only. In this case of cancellation, the charges will be refunded. However, a discretionary fee may be applied for administrative cancellation charges. From the time the parcel is handed over to the carrier, no modifications or cancellations may be accepted and the charges will not be refunded.

Post & Packaging

Standard Delivery Charge: £5.50

Special Delivery Charge: £7.00

Post & packing prices are based on orders to UK mainland addresses only. Please add any additional delivery information in the box provided to assist in the delivery of your order.

We will not send any orders without a VALID POSTCODE. If You provide an incorrect address, including the postcode, We will not accept any responsibility for the failure of an order to arrive or any costs involved in redirecting that order.

Dispatching Orders

If we receive your order before 10am on Monday to Thursday we will strive to get your order dispatched on the same day, although this is not always possible. Due to the handmade process of making Our chocolates orders may take up to 5 days to be dispatched. In the event that we cannot satisfy your order due to stock unavailability, we will contact you to offer you an alternative. However, if this would prevent us from meeting your required delivery date, we will send suitable substitutes of the same or higher value and contact you afterwards.

Special Delivery

If You opt for special delivery We will dispatch your order on the same day and send it via next day delivery as long as the order was received before 1pm (Monday to Thursday). Because delivery is handled by outside contractors we cannot guarantee delivery although we use our reasonable endeavors to ensure delivery on the date requested.

If Special Delivery orders are received outside of the above times We will still try to send the order on the same day, failing this orders will be sent the next working day.

Any orders received on Friday will only be sent out on Monday, as chocolates are perishable items and should not be waiting for delivery in some postal storeroom over the weekend.

Damaged Order

In the unlikely event that Your purchase is damaged in transit please contact Us within 24 hours of receipt. Products received by courier should be checked before being signed for. If the exterior packaging or the product are found to be damaged You must then sign "checked and found to be damaged". If You fail to do this We may not be able to offer a refund.

Undelivered Order

If Your order is sent by Royal Mail and is not delivered please contact Us for details of the tracking and tracing procedures. If products are sent by Courier and not delivered please contact Us for details of the online and telephone tracking procedure.If orders are considered by Us to be lost in transit after a reasonable period time has elapsed we shall at Our discretion either refund or resend Your order.

Extreme Weather Conditions:

If the weather is extremely hot or cold, We reserve the right to delay Your order until the weather has returned to moderate conditions. As we feel that your chocolates should arrive to you in the best condition. In extreme situations this can delay orders for several days. For urgent orders We will then contact You for authority to send your order. However, if You do authorise Us to dispatch Your order We cannot accept any liability for damage or loss.
